TERMS AND CONDITIONS
1. Parish Pest Control is not responsible or liable for any insect bite(s) or sting(s) that may occur to any person in/on the property treated.

2. FUTURE DAMAGE

Parish Pest Control is not responsible for and does not guarantee against present or future damage to the building or contents or provide for the repair or
replacement thereof. This agreement does not provide for the control of termites, fungus, beetles, or any other pests not indicated herein. This plan does not guarantee, and Parish Pest
Control does not represent, that covered insects will not return to the Property.

3. PURCHASER RESPONSIBILITY

Your cooperation is important to ensure the most effective results from Parish Pest Control. Whenever conditions conducive to the breeding and
harborage of pests are reported in writing by Parish Pest Control, and not corrected by you, Parish Pest Control cannot assure satisfactory service. If the conditions noted by Parish Pest
Control are not corrected as required, all guarantees in this agreement shall automatically terminate and be canceled. Further, additional treatments in areas of such conditions that are
not corrected as required shall be paid for by the customer as an extra service charge.

4. NOTICE OF CLAIMS/ACCESS TO PROPERTY

Any claim arising out of this Agreement must be made in writing by Purchaser to Parish Pest Control during the term of this Agreement.
Purchaser must allow Parish Pest Control access to the identified property for any purpose contemplated by this Agreement. The failure to promptly allow Parish Pest Control such access
will terminate this Plan without further notice.

5. NONPAYMENT/DEFAULT

The obligation of Parish Pest Control hereunder is conditioned upon payment in full of the Initial charge and all regular service charges, and failure to pay
such charges shall cancel this Plan in its entirety and discharge Parish Pest Control of any liability, and any amount paid shall become the property of Parish Pest Control.

6. DISCLAIMER. A. FORCE MAJEURE.

The liability of Parish Pest Control under this Agreement will be terminated if Parish Pest Control is prevented from fulfilling its responsibilities under the
terms of thisAgreement by reason of delays in transportation, shortages of fuel and/or materials, strikes, embargoes, fires, floods, quarantine restrictions, earthquakes,
hurricanes, or any other act of God or circumstances or cause beyond the control of Parish Pest Control. Parish Pest Control reserves the right to adjust the service charge
in the event of any such occurrences or happenings.
B. OTHER INSECTS/ORGANISMS. This Agreement provides for treatment and re-treatment for pests indicated herein. This Agreement does not provide for treatment of
subterranean termites (Reticulitermes spp., Heterotermes spp., Coptotermes spp.), drywood termites (Kalotermes spp., incisitermes spp., Cryptotermes, spp.), carpenter
ants, fleas, bedbugs, beetles, fungi, or any other wood destroying organisms.
C. CHANGE IN LAW. Parish Pest Control performs its services in accordance with the requirements of law. In the event of a change in existing law as it pertains to the
services herein. Parish Pest Control reserves the right to revise the service charge or terminate this Agreement.
EXCEPT AS OTHERWISE PROHIBITED BY LAW PARISH PEST CONTROL DISCLAIMS AND SHALL NOT BE RESPONSIBILE FOR ANY LIABILITY FOR INDIRECT, SPECIAL, INCIDENTAL,
CONSEQUENTIAL, EXEMPLARY, PUNITIVE, STIGMA AND/OR LOSS OF ENJOYMENT DAMAGES. THE OBLIGATIONS OF PARISH PEST CONTROL SPECIFICALLY STATED IN THIS
AGREEMENT ARE GIIVEN IN LIEU OF ANY OTHER OBLIGATION OR RESPONSIBILITY, EXPRESS OR IMPLIED, INCLUDING ANY REPRESENTATION OF MERCHANTABILITY OR FITNESS FOR
A PARTICULAR PURPOSE.

7.ENTIRE AGREEMENT.

This Agreement, these Terms and Conditions and any Inspection Graphs constitute the entire Agreement between the parties and no other representations or
statements, whether oral or written, shall be binding upon the parties.

8.MANDATORY ARBITRATION.

The Customer and the Company shall agree that any controversy or claim between them arising out of or relating to this agreement shall be settled
exclusively and finally by arbitration. The arbitration shall be conducted in accordance with the Louisiana Binding Arbitration Law, La. Rev. Stat. 9:4201 et seq. The arbitrator shall be a
neutral third party mutually chosen by the Customer and the Company to hear their claims and render a decision. The decision of the arbitrator shall be a final and binding resolution of
the disagreement, which may be entered and made enforceable by any court of competent jurisdiction. The parties hereto agree that neither party shall sue the other over anything
contained in this agreement except for enforcement of the arbitrator’s decision. In no event shall either party be liable to the other for indirect, special, or consequential damages or loss
of anticipated profits.

9.PESTICIDE LABELS. UPON REQUEST, PARISH PEST CONTROL WILL PROVIDE PURCHASER WITH A COPY OF THE MANUFACTURER’S SPECIMEN LABEL FOR THE PESTICIDE(S) WHICH
WILL BE USED TO TREAT THE PREMISES.
Payment Authorization Agreement
1. Authorization to Charge Credit/Debit Card:
By providing your card information, you authorize Parish Pest Control to charge your card for the following purposes:
A. Payment for goods and/or services provided by the Parish Pest Control
B. Any additional charges related to changes or cancellations as outlined in our terms and conditions.
C. Any other fees or amounts that may be due under this agreement.
2.Amounts and Charges:
Parish Pest Control will charge your card for the amounts agreed upon in your invoice or purchase order. You acknowledge that you are responsible for ensuring that the information
provided is accurate and for promptly addressing any discrepancies or issues related to charges.
3.Recurring Payments (if applicable):
For services that involve recurring payments, you agree to a recurring billing cycle and authorize Parish Pest Control to charge your card accordingly. The frequency and amount of such
charges will be as specified in the service agreement.
4.Dispute Resolution:
In the event of a dispute regarding any charge, you agree to contact Parish Pest Control directly to resolve the issue before disputing the charge with your card issuer.
5.Revocation of Authorization:
You may revoke this authorization by providing written notice to Parish Pest Control. However, revocation will not affect charges incurred prior to the revocation notice.
6.Security and Privacy:
Parish Pest Control is committed to safeguarding your card information and will handle it in accordance with applicable privacy and data protection laws.
7.Termination:
This authorization will remain in effect until terminated by either party in writing or as otherwise provided in the agreement.

 

Standard Refund Policy for Pest Control Services

  1. Satisfaction Guarantee
    We strive to provide effective and reliable pest control services. If you are not satisfied with the results within [30 days] of the initial service, please contact us. We will re-service your property at no additional cost to address the issue. A refund is also contingent on the client following all prep procedures before and follow up procedures after treatment(s) and sanitation recommendation(s) followed by the client from parish pest control.
  2. Refund Eligibility
    Refunds may be provided under the following circumstances:
  1. If we are unable to control the identified pest problem after [two or three] re-treatments within a reasonable timeframe.
  2. If the issue persists despite documented and appropriate preventive measures by the customer.
  1. Service-Specific Refunds
  1. One-Time Treatments: Refunds may be issued only if the treatment did not meet guaranteed service outcomes as per our terms.
  2. Recurring Services (Monthly/Quarterly Plans): Cancellations must be requested at least [7-14 days] before the next scheduled service. Refunds are prorated based on unused services.
  3. Exclusions: No refunds are provided for immediate or emergency services.
  1. Non-Refundable Items
    The following services and fees are non-refundable:
  1. Initial inspection or consultation fees
  2. Damage repairs related to pest infestations
  3. Treatments outside the scope of the original agreement
  1. Customer Responsibilities
    Refund eligibility requires customers to follow our pest prevention recommendations, such as sealing entry points and maintaining property cleanliness.
